Part I — Terms of Service

1. Acceptance of Terms

These Terms of Service (hereinafter “Agreement” or “Terms”) constitute a legally binding contract between you, the individual or entity requesting services (hereinafter “Customer,” “you,” or “your”), and Scenic City Mobile Auto Tech, a mobile automotive service business operating in and around Chattanooga, Tennessee (hereinafter “Company,” “we,” “us,” or “our”).

By requesting a booking through our website, submitting a booking form, communicating with us via telephone or electronic means, or otherwise engaging our services in any capacity, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety, without modification.

If you do not agree to these Terms, you must not submit a booking request or engage our services. Use of our booking form or engagement of any service constitutes your unconditional acceptance.

These Terms apply to all services provided by Scenic City Mobile Auto Tech, including but not limited to mobile automotive repair, diagnostic services, battery services, tire services, roadside assistance, and any other services described on our website or communicated to you.

2. Services Provided

2.1 Nature of Services

Scenic City Mobile Auto Tech provides mobile automotive services, meaning our technicians travel to your specified location to perform the requested work. The Company does not operate a fixed-location repair facility. Services are performed at the location you designate at the time of booking, subject to accessibility, safety, and technician judgment.

2.2 Service Area

Services are available within our designated service area in and around Chattanooga, Tennessee. We reserve the right to decline service requests located outside our current service area or in locations we determine to be unsafe or inaccessible for our technicians and equipment.

2.3 Technician Judgment

Our technicians retain professional discretion to determine whether a requested service can be safely and effectively performed at your location under existing conditions. If a technician determines that the requested service cannot be safely completed, the appointment may be terminated at no charge, and we will work with you to arrange an alternative. We are not liable for any inconvenience resulting from such a determination.

2.4 Estimates

Any quoted price provided at the time of booking is an estimate based on the information you supply. Final pricing may vary based on actual conditions observed by the technician, additional parts or labor required, or services identified during the appointment. You will be notified of any material deviation from the estimate prior to proceeding with additional work.

3. Booking, Scheduling & Cancellation

3.1 Booking Process

A booking request submitted through our online form or by telephone does not constitute a confirmed appointment until you receive an explicit written confirmation from the Company indicating that a technician has been assigned and the appointment is confirmed. We reserve the right to accept or decline any booking request at our sole discretion.

3.2 Your Obligations at Appointment

You agree to ensure that: (a) the vehicle described in the booking is present and accessible at the specified location at the scheduled time; (b) a person of legal age is present or reachable by telephone at the appointment location; (c) the location is safe, legally accessible, and provides adequate working space for our technician; and (d) accurate information regarding the vehicle, its condition, and the requested service has been provided.

3.3 Rescheduling

Either party may request to reschedule an appointment. We will provide advance notice of any Company-initiated reschedule and work in good faith to find a mutually agreeable alternative time. We are not liable for losses arising from rescheduled appointments.

3.4 Cancellations

If you must cancel an appointment, please contact us as soon as possible at (423) 646-0504 or info@scenicautotech.com. Cancellations made with less than two (2) hours’ notice of the scheduled appointment time may, at the Company’s discretion, result in a service call fee to cover technician travel and preparation time. We reserve the right to waive any such fee at our discretion.

3.5 No-Shows

If a technician arrives at the specified location and cannot access the vehicle or reach a responsible party after reasonable attempts, the appointment may be recorded as a no-show. A no-show service call fee may apply. Repeat no-shows may result in restriction of future booking privileges.

4. Communications Consent — SMS & Email

Read this section carefully. It governs how we communicate with you regarding your booking. Your explicit consent to at least one form of communication is required to complete a booking.

4.1 Required Communication Consent

To book a service with Scenic City Mobile Auto Tech, you must consent to receive communications through at least one of the following channels: (a) electronic mail (email), or (b) Short Message Service text messaging (SMS). This requirement exists solely to ensure you receive timely and accurate information about your appointment, including confirmation, updates, and any changes made by either party.

You may freely choose to opt in to one or both channels. You may not opt out of both channels simultaneously while maintaining an active booking. Opting out of all communication channels will result in cancellation of any unconfirmed booking requests associated with your contact information, as we have no means of delivering required booking information.

4.2 Email Consent

By opting in to email communications, you expressly consent to receive transactional emails from Scenic City Mobile Auto Tech at the email address provided, including: booking request acknowledgment, booking confirmation or decline notification, appointment reminders, rescheduling notifications, and service completion summaries. These are transactional communications, not marketing emails, and are not subject to commercial email opt-out requirements under the CAN-SPAM Act of 2003 to the extent they relate solely to your booked service.

4.3 SMS Text Message Consent

By opting in to SMS communications, you expressly consent, in writing, to receive text messages from Scenic City Mobile Auto Tech at the mobile telephone number you provide. The categories of SMS messages you may receive include:

  • Booking confirmation upon technician assignment
  • Appointment reminders prior to your scheduled service
  • Rescheduling notifications if your appointment time changes
  • Status updates related to your active booking

SMS messages are sent solely for the purpose of facilitating your booked service. We do not send unsolicited marketing, promotional, or advertising messages via SMS.

Message & Data Rates May Apply. Standard message and data rates charged by your mobile carrier may apply to SMS messages you receive from us. Message frequency varies depending on your booking activity. You are responsible for any charges imposed by your carrier.

4.4 Opting Out of SMS

You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. Upon receipt of a STOP message, we will cease sending SMS communications to that number. You may also opt out by contacting us directly at info@scenicautotech.com or (423) 646-0504. Opting out of SMS will not affect your email communications, and vice versa, unless both channels are independently opted out. If you opt out of SMS mid-booking, we will communicate remaining booking information via email, provided email consent remains active.

4.5 Opting Out of Email

You may request removal from email communications by contacting us at info@scenicautotech.com. Please note that during an active booking, removal from email communications may impair our ability to deliver critical appointment information. If you withdraw email consent while a booking is active and SMS consent is also inactive, we will be unable to fulfill our communication obligations and may need to cancel the affected booking.

4.6 Help & Support

To receive help regarding our SMS program, reply HELP to any text message you receive from us, or contact us directly at (423) 646-0504 or info@scenicautotech.com.

4.7 No Third-Party Messaging

All SMS and email communications are sent directly by Scenic City Mobile Auto Tech or through our designated communications service provider(s) acting solely on our behalf and subject to confidentiality obligations. Your contact information is not shared with any third party for the purpose of sending marketing or promotional messages.

5. Payment & Pricing

5.1 Payment Due

Payment for services rendered is due at the time of service completion, unless otherwise agreed in writing prior to the appointment. Accepted payment methods will be communicated at the time of booking or upon request.

5.2 Disputed Charges

If you believe a charge is in error, you must notify us in writing within seven (7) calendar days of service completion. We will review and respond to all good-faith disputes within a reasonable time.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Scenic City Mobile Auto Tech, its owners, officers, employees, agents, and technicians shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, your booking, or these Terms, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from a single service appointment shall not exceed the amount you paid for that specific appointment.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded or limited.

7. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis. While we take pride in the quality of our work and our technicians’ professionalism, we make no representation or warranty — express, implied, or statutory — that any service will achieve a specific outcome, resolve an underlying vehicle condition not directly addressed by the requested service, or that any estimate of time or cost will be precisely accurate.

We warrant that services will be performed in a workmanlike manner consistent with industry standards. Any warranty on parts installed is subject to the terms of the applicable parts manufacturer and will be communicated at the time of service.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or our services that cannot be resolved through good-faith negotiation shall be subject to binding arbitration in Hamilton County, Tennessee, in accordance with the rules of a mutually agreed arbitration body, or, if no such agreement is reached, before a court of competent jurisdiction in Hamilton County, Tennessee.

You waive any right to participate in a class action lawsuit or class-wide arbitration relating to our services.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated by updating the effective date at the top of this document and, where practicable, by notifying you via email or the website. Your continued engagement of our services after the effective date of any revision constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.


Part II — Privacy Policy

Scenic City Mobile Auto Tech is committed to protecting the privacy of every person who contacts us, requests a booking, or engages our services. This Privacy Policy describes what personal information we collect, why we collect it, how we use it, and — critically — what we do not do with it.

The short version: We collect only what we need to provide and communicate about your automotive service. We do not sell your information. We do not share it with advertisers. We do not give it to data brokers. Full details are below.

10. Information We Collect

We collect information in the following categories, all of which is provided voluntarily by you in connection with a booking request or service inquiry:

Contact Information: Your first and last name, email address, and mobile telephone number.
Vehicle Information: Year, make, model, and any notes you provide regarding your vehicle’s condition or history relevant to the requested service.
Service Location: The street address, city, state, and ZIP code at which you request service.
Booking Details: Requested service type, requested date and time, and any special instructions or notes you provide.
Communication Preferences: Your explicit opt-in selections for email and/or SMS communications as recorded at the time of booking.
Service History: Records of services we have performed for you, including dates, services rendered, and quoted/charged amounts, retained for warranty, service record, and customer service purposes.
Technical Data: Standard website access logs including IP address, browser type, and pages visited, collected automatically by our web hosting infrastructure. This data is used solely for security and site performance purposes.

We do not collect Social Security numbers, driver’s license numbers, credit card numbers, bank account information, or any government-issued identification numbers through our booking system. Payment information, if collected electronically, is processed through a compliant third-party payment processor and is not stored by us.

11. How We Use Your Information

We use the personal information you provide exclusively for the following purposes:

  • To process and confirm your booking — reviewing your request, assigning a qualified technician, and confirming the appointment.
  • To communicate with you about your appointment — sending confirmation, reminder, reschedule, and status update messages through the channel(s) you have selected.
  • To perform the requested service — providing your technician with the necessary information to arrive prepared at your location.
  • To maintain service records — retaining a history of services performed for warranty reference, repeat service efficiency, and your own records upon request.
  • To improve our services — using aggregated, anonymized data to understand demand, service patterns, and scheduling needs. This analysis does not identify you individually.
  • To comply with legal obligations — retaining records as required by applicable federal, state, or local law.

We do not use your personal information for any purpose not described above without first obtaining your express consent.

12. SMS Messaging Policy

This section constitutes our full SMS messaging disclosure as required by applicable telecommunications regulations, including the Telephone Consumer Protection Act (TCPA), FCC regulations, and the CTIA Messaging Principles and Best Practices.

12.1 Program Description

Our SMS program, “Scenic City Mobile Auto Tech Booking Notifications,” is used exclusively to send transactional messages related to your service booking. This is a non-marketing, service-only program. You will receive messages only after providing your affirmative written consent through our booking form.

12.2 Message Frequency

Message frequency varies by booking activity. Typically, you may receive between one (1) and four (4) messages per booking: a booking confirmation, one or more reminders, and any rescheduling or status-change notifications. We will not send messages unrelated to your booking.

12.3 Opt-Out Instructions

You may opt out at any time by replying STOP to any message. We will confirm your opt-out and immediately cease sending messages to that number. You may opt back in at any time by contacting us and providing renewed consent.

12.5 Carrier Disclaimer

Wireless carriers are not liable for undelivered or delayed messages. Message and data rates may apply depending on your mobile carrier plan.

12.6 Supported Carriers

Our SMS program is supported by all major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint (T-Mobile), and regional carriers. Support by a specific carrier is not guaranteed and may change without notice.

13. Email Communications Policy

Emails sent in connection with your booking are transactional in nature. They are sent from info@scenicautotech.com or a designated service email address clearly identified as being from Scenic City Mobile Auto Tech. We do not send bulk promotional email campaigns, newsletters, or advertisements without your separate and explicit consent for such communications.

If you receive an email from us that you believe is unsolicited, please contact us immediately at info@scenicautotech.com so we can investigate and correct any error.

14. No Sale or Sharing of Personal Data

We do not sell, rent, lease, trade, or otherwise transfer your personal information to any third party for commercial purposes. This is an unconditional commitment.

We may share your information in the following limited, non-commercial circumstances only:

  • Service delivery partners: We use third-party platforms to facilitate our booking system, send SMS notifications (through a registered messaging service provider such as Twilio), and send email communications. These providers receive only the minimum information necessary to perform their specific function and are contractually prohibited from using your data for any other purpose.
  • Legal compliance: We may disclose your information if required by law, court order, subpoena, or government regulation, or if we have a good-faith belief that disclosure is necessary to protect the rights, property, or safety of the Company, our customers, or the public.
  • Business succession: In the event of a merger, acquisition, or sale of all or substantially all of our business assets, your information may be transferred to the acquiring entity. In such an event, we will provide notice and the acquiring entity will be bound by the terms of this Privacy Policy or a policy providing at least equivalent protections.

Under no circumstances do we sell or provide your contact information, vehicle information, or service history to advertisers, data brokers, marketing aggregators, or any party for purposes unrelated to your service.

15. Data Retention

We retain your personal information for as long as is reasonably necessary to: (a) fulfill the purposes for which it was collected; (b) maintain accurate service history records for your benefit; (c) comply with applicable legal obligations including tax and business record retention requirements; and (d) resolve disputes and enforce our agreements.

Service records are typically retained for a period of seven (7) years following your last service appointment, consistent with Tennessee business record retention standards. Communication preference records (your opt-in and opt-out history) are retained for a minimum of five (5) years to demonstrate compliance with applicable telecommunications regulations.

You may request deletion of your personal information at any time, subject to our legal retention obligations. See Section 17 for how to submit such a request.

16. Security

We implement commercially reasonable technical, administrative, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include access controls, encrypted data transmission, and restricted access to personal information on a need-to-know basis.

No method of data transmission or electronic storage is perfectly secure. While we take your privacy seriously and work diligently to protect your information, we cannot guarantee absolute security. In the event of a data breach that is likely to result in risk to your rights and freedoms, we will notify you and applicable regulatory authorities as required by law.

17. Your Rights

Regardless of your state of residence, we honor the following rights with respect to your personal information:

  • Right of Access: You may request a copy of the personal information we hold about you.
  • Right of Correction: You may request correction of inaccurate or incomplete personal information.
  • Right of Deletion: You may request deletion of your personal information, subject to our legal retention obligations described in Section 15.
  • Right to Opt Out of Communications: You may opt out of SMS and/or email communications as described in Sections 12 and 13. Please note the effect on active bookings described in Section 4 of the Terms of Service.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of the rights described in this section.

To exercise any of these rights, please contact us using the information in Section 18. We will respond within thirty (30) days of receiving a verifiable request. We may ask you to verify your identity before processing your request.
